It appears the Trump team have finally got a case through to the Supreme Court (known also as SCOTUS). News of this is minimal, indeed practically skeletal. Biden supporters (sometimes called “the media”) may not want to mention anything that isn’t a Trump loss. And everyone else is not sure if the deadline matters. The Supreme Court has given people til Dec 9 to respond, but the electoral college has a “safe harbor” deadline of Dec 8. Sidney Powell says with fraud cases the deadline doesn’t matter. But this doesn’t look like a fraud case. Here’s the Supreme Court docket which has a link to the Amicus Brief Document.

Alito, who handles emergency matters arising out of Pennsylvania for the court, gave state officials until Dec. 9 to file their reply — one day after the federal deadline for locking the state’s slate of electors in place.

More likely, Alito’s action means he and some other Justices take the matter seriously, and plan to rule on the merits once the opposition is submitted.
There is a lot of chatter that such a long period of time, under the circumstances, must be a way for Alito to let the application die on the vine, that the application would be “moot” or otherwise pushing it off to make meaningful relief impossible. Certainly, we can’t read Alito’s mind, but if there’s anyone on SCOTUS I don’t worry about playing such games, it’s Alito (and Thomas, too early to tell for Gorsuch, Kavanaugh, or Barrett).
In my mind-reading exercise, Alito giving the respondents’ enough time to fully prepare opposition likely means he and some other Justices take the matter seriously, and plan to rule on the merits once the opposition is submitted, rather than limiting their ruling to emergency injunctive relief. They could treat the Emergency Application as a Petition for Certiorari, accept it, and rule substantively. The few days gives the Justice enough time to prepare their respective opinions — it’s not like they really need briefs from the respondents to know the counter-arguments.

The Democrats, I’m sure, were just doing their best to protect polite society from Rude Intolerant Rulers, without necessarily realizing that they had become the rude intolerant rulers they were trying to stop. It’s a means to an end.
The thing about harassment and bullying though, is that the more people see whistleblowers come forward, the more they will speak out. The trickle can become a flood.

Carone was a contractor for Dominion working at the TCF Center in Detroit on Nov 3 and 4. The tabulating machines were jamming, but instead of being reset to zero and cleared, which stops double counting, poll workers were just repeatedly scanning the same votes. Instead of counting ballots 50 at a time, the tally was up to 500 or more. When she tried to report that she got nowhere.
“He [Nick] said, ‘Melissa I don’t want to hear that we have a problem, we are here to assist with IT, we are not here to run their election.’ And at that point, I was really frustrated and upset, I could tell what was going on,” she continued. “They were cheating. It was very, very apparent.”
She claims as may as 30,000 votes may have been scanned more than once. Another poll challenger testified and confirmed that machines were jamming and people didn’t know how to handle it. Was it really that many?
A forensic audit would be a start. Biden will heal the nation with one any day now…

It’s worth listening to the detail to understand just how brazen and audacious and fraudulent the activity was in Detroit.

The team in State Farm Arena in Atlanta sent home observers and the press, said they’d stop counting. But then those dedicated and democratic souls decided to work on for at least two more hours during which time they pulled four suitcases out from under a table and took them to the machines and processed them all night, all captured on the CCTV. What’s the penalty for fake ballots in Georgia?
At 10pm in State Farm Arena, all the other poll observers and Fox news were sent home and told the counting would resume in the morning. But after they left, a woman in a yellow shirt pulled a suitcase out at 11:02pm and took it to the counting desks.
We all know what kinds of ballots don’t come in official boxes and don’t need to be viewed by Republicans.
The question is — will the Democrats be able to win the Georgia Senate Runoffs if Republican poll watchers refuse to go home til the counting is finished?
The other question is — was there CCTV from all the other swing states and when can we see that too?

These machines can process about 3,000 ballots an hour. There are multiple machines and they worked for two hours in the dead of night. The operation goes on til 12:55am. It’s easily possible there were enough ballots processed to change the election outcome just in this one operation.

Jacida Ardern declared that New Zealand faces a climate emergency. She may think it’s just symbolic but there are prices, aside from making the word “emergency” just that much more useless. Ardern has stepped into a psychology trap like a public Chastity Vow. She and everyone who voted for it will be measured against this in everything they do. She’s been captured just that bit tighter. The defence permits law-breaking in circumstances of “sudden or extraordinary emergency” if:

It’s a version of the common law “necessity defence”, which allows law-breaking to avoid greater harm or irreparable evil. This defence has been argued by climate activists in the US and UK for over a decade.
Emergencies are also the choice du jour for censorship. It’s that much easier to declare that people who discuss the role of the sun in climate change are dangerous thinkers.

Counties with more suspicious birthdays were more likely to vote for Biden
When people picked fake dates for fake voters they didn’t spread them in a normal pattern through the year. Instead of having more birthdays in the summer months (which is normal in the US) there were more births than expected in December and January. There were also more birthdays on the nice round numbered days like the 10th, 20th and 30th days of the month.
In a layered and detailed study Carl Bell uncovers how wildly unlikely these birthdays are. Not only are the days suspicious, the months are too, and then there is the red hot flag that the counties with the oddest birthday patterns are usually Biden supporters. And furthermore, they are counties that differed the most from their past voting behaviour and also counties with higher votes for third parties too (like the libertarians). It’s almost like fake voters wanted Joe Biden to win, but not win by too much, so they had to add in some votes for “others” as well.
The “birthday” tool could not only to be used to spot suspicious counties in the first place, it was so detailed it could give an estimate of what votes might have been if those outlier counties had had a more normal distribution.
As usual, when they take out the fakes, Trump won.
This looks like something that would be useful in a court of law. “Beyond reasonable doubt”.
It’s a sign of the caliber of the Trump supporters, and another weapon in the game. Studies like this motivate the good guys and must surely make some people more nervous.
We construct a new metric of potential voter fraud using suspicious distributions of birthdays in Pennsylvania voter registration data. The basic idea is that people picking fake birthdays will make predictable non-random choices, like picking round numbers for days of the month, and not knowing what true birth month distributions look like.
Under this metric, a number of counties in Pennsylvania have extremely unlikely distributions of voter birthdays. Seven counties representing almost 1.4 million votes total (Northumberland, Delaware, Montgomery, Lawrence, Dauphin, LeHigh, and Luzerne) have suspicious birthdays above the 99.5th percentile of plausible distributions, even when using conservative assumptions about what these distributions should look like.

These suspicious birthdays also matter significantly for election outcomes. While there are suspicious counties that vote Republican overall, in general more suspicious birthdays in a county are strongly associated with a larger Biden vote share, and a higher Biden vote share relative to all Democrat presidential candidates since 2000. More suspicious birthdays are also associated with a higher vote share for Jorgensen relative to Trump (consistent with a fraud scheme aiming to get Biden high but not “too high”, while simultaneously giving as few votes to Trump as possible).
Finally, we quantify the magnitude of how this potential fraud may have impacted the election. Even a small reduction in the amount of suspicious birthdays (to the 98th percentile of the conservative distribution) would be predicted to have resulted in Trump winning the state by 71,500 votes. This suggests that whatever is driving the anomalous patterns in birthdays is sufficiently important to affect the statewide election result.
In Mongomery there were an awful lot of births in the colder months — see how far the red line is outside the normal curve?

First, they must explain why the distribution looks so anomalous in the first place. That is to say, the level of the distribution looks wrong. And even if this is accomplished, they must also explain why these deviations should predict so many aspects of vote outcomes – not just Democrat performance, not just Democrat performance relative to all recent elections, but also the relative preference for Libertarians and Republicans.

…. Third, more suspicious birthdays are also associated with higher vote shares for Jorgensen relative to Trump. This is an additional likely consequence of fraud – if a perpetrator wants to maximize the overall contribution to Biden over Trump in the statewide race, and doesn’t want to report an implausibly high overall vote for Biden, the only alternative is to add votes to Jorgensen.

PS: For anyone who read the 780% of voter turnout yesterday from one precinct in Michigan, the huge number was very likely a decimal point error. See the update. Many questions remain about the other precincts showing 100% voter turnout.
UPDATE: A Big Thankyou to Pedant General and B. Hicks for the official count for North Muskegon (page 459) shows this was likely a decimal point error and turnout was 78% not 780%. Headline Changed (Original “Was that a 780% turnout in North Muskegon, Michigan?”). Things may still be far out of the ordinary in North Muskagon. Academic Agent claims the turnout in 2012 in this same county was just 25%. In 2016 it was 55%. Somehow the Precinct was transformed from an apathetic low voter place to a place that turned out in historic numbers. Hypothetically, if people intending to cheat were going to find thousands of votes the counties with the lowest voter turnout would be the best places to start. That said, it’s so much better if Affidavits got the numbers correct. Shame something as important as a free and fair election is not being investigated in this kind of details by institutions with major resources and many staff like the DoJ and the FBI.

You’ve heard of impossible voter turnouts in the USA and you were wondering why no one just listed the counties with the counts. Well here they are. Thanks to David E for finding them.
Many precincts of Michigan had a 100% turn out which is impressive in itself, but it was the 200, 400 and 800% turnouts that really take the cake. Ponder the kind of brazen cheating (or perhaps rushed panicked mistakes) that takes. Even if there was a record high turnout of 80% in Michigan — 15% above normal — that would imply there were 36,812 extra zombie voters.
Below, see how one audit suggests that nearly one in ten absentee voters lives on a vacant lot or in a cemetery.
They make remarkable claims. These are both three star Lieutenant Generals, effectively endorsing each other and Trump and suggesting CIA involvement, foreign interference, and talking of crack US soldiers seizing servers in Germany that were controlled by the CIA.
The implications are that there are sections of US intelligence on opposite sides of the battle. This might explain why, at one point, Sidney Powell said she wasn’t sure if the good guys or the bad guys had the servers in Germany. (The good guys apparently got the servers in the end, but possibly at the highest price, and we wait to find out what, if anything, was on them).
Not many in the US would know more about intelligence operations than Michael Flynn — the 18th Director of the Defense Intelligence Agency (DIA) under Obama and the National Security Adviser under Trump. Thomas G. McInerney is a retired United States Air Force Lieutenant General who flew in 407 combat missions during the Vietnam War. He was also Assistant Vice Chief of Staff of the US Air Force.
“We’ve never seen treason of this magnitude ever in our history” declared McInerney. “Trump must not let deadlines stop him fulfilling his oath to defend the country against all enemies, both foreign and domestic”.
In this strange election twilight zone, there is no easy way to verify much. In a normal world (the one we thought we lived in six weeks ago) we’d expect the media to put this sort of thing on the front page. In a normal world, if the BBC didn’t mention it, perhaps it didn’t happen. But the normal world hasn’t been normal for years. Gradually more things became Undiscussed — like cold snaps and scientists hiding declines. But, now the censorship fog has arrived like a Brown Dwarf snuck up on the solar system.
Keep your skeptical hat on. It sounds like a Tom Clancy thriller. It would make a great movie. And both sides have an interest in a Big Bluff.
What is the CIA’s role in cyberwarefare
One America News (OANN) has done a good job of summarizing that story.
One Rep. Louie Gohmert claimed there was a raid on a Scytl server in Germany. Scytl though denies it, and the man that Trump sacked that used to run the Cybersecurity and Infrastructure Security Agency (CISA) said it didn’t happen and the Army said “no” too. But then most official agencies probably don’t explain and confirm all the movements of their intelligence forces. Possibly those doing the PR don’t even know them. What was that saying — don’t believe it til it’s officially denied?
It’s not so much a civil war as a cyberwar

We’ve mentioned the CIA programs called Hammer and Scorecard before.Hammer was surveillance software developed by Dennis Montgomery for the CIA under the Bush Government to go after radical islamists. We know this because Montgomery has since become a whistleblower. Scorecard was used to influence foreign elections to help elect leaders the US preferred. I did say “There is a karma to this.” If the US was involved in rigging foreign elections, (while supposedly promoting democracy) — is it any wonder the same tool came back to bite? And fast too, like vote flipping at the speed of light. Just two weeks after Obama took office (two weeks!), the programs were moved out of the CIA custody and into a group that could use it against the citizens of the United States.
Software that can control nations is like free opium — we can’t leave it lying around and not expect someone to use it.
Kraken is a crack military intelligence team
In another part of the interview McInerney explains that “Kraken” means the 305th Military Intelligence Battalion who have been helping The President. He identifies China, Russia and Iran as being involved in manipulating votes.
In the full interviewthe claims about the German servers were at 26 minutes. McInerney takes over from Flynn at 32 minutes. The Kraken claim is at about the 42 minute mark. Mary Fanning finishes. She’s been involved for years in investigating this and has written a whole book: “THE HAMMER is the Key to the Coup “The Political Crime of the Century”: How Obama, Brennan, Clapper, and the CIA spied on President Trump, General Flynn … and everyone else”
According to Fanning, McInerney and Flynn, the US Special Forces seized servers in Frankfurt Germany that were allegedly controlled by the CIA. If so, this would be Military Government forces against Civilian Government forces. A dire situation especially given that McInerney mentions that he has also heard there may have been fatalities during the seizure. He stresses that this is unverified.

A band of 26 Pennsylvania House lawmakers are circulating a memo seeking support of a proposed resolution declaring the state’s certification of presidential electors and other statewide election results to be “in dispute”.
Declaring the results of statewide electoral contests in the 2020 general election to be in dispute, a group of House Republican lawmakers have announced their intention to introduce a resolution calling for Gov. Tom Wolf and Secretary of State Kathy Boockvar to withdraw their certification of the Nov. 3 election results in the presidential and other statewide contests.
In Pennsylvania, the Republicans control the House and Senate. Rudy Guiliani and the Trump team presented a compelling case with witnesses and evidence of voter fraud at the Senate Hearing on Wednesday. So much so that many Republicans are galvanized.
CBS Pittsburgh: The resolution has not yet been voted on by either the state House or Senate. It is not expected to get a vote before lawmakers’ terms end on Monday.
Lt. Gov. John Fetterman told KDKA last week that if the votes are not certified in Pennsylvania by Monday, Nov. 30, there will be no members of the state House and half the state Senate will not be in office as that is when their terms expire.
Jenna Ellis says that Governor (a Democrat) does not have the power to stop this. The sole power resides with the House and Senate. It is a constitutionally designated role. In theory (according to her) they are able to override this corruption.
Apart from the incredibly tight timing, there is potentially the problem of a few last RINO’s who may not join in the vote.

Where the heck are the Media?
Tonight on the news we heard about the case Trump lost in PA, but not the one he won, not the remarkable explanation by Judge McConnell, and not the extraordinary, historic move by the State representatives to overturn the result, and never ever the long lists of election fraud.
Don’t hunt for clues or information, or even coherent sentences from the Twitterati commentariat. Though it’s a good place to see what kind of mass blindsiding may be coming.
History is unfolding and the media are actively hiding it.
UPDATE: It appears a near simultaneous ruling by a higher court has overturned this overturning. Expect it to be appealed further up the chain. That the legal battle ensues proves the TV Gods called the election too soon.
In Pennsylvania two days ago Judge McCulloch issued a court order to stop the certification of votes but has now written up the reasons why in a Memorandum Opinion. In extraordinarily clear language the Judge declares that the amended absentee and mail-in provisions in Pennsylvania were unconstitutional and void ad initio because it contravenes the requirements of the Pennsylvania Constitution.
The reason for the injunction are the “compelling exigencies raised in this case which are of statewide and national concern”.
Petitioners raise matters that go to the core of the electoral process and involve the constitutionality of how the citizens of this commonwealth may cast their votes, not only for the offices sought by petitioners, but also, for the office of president and vice president of the United States of America as well as statewide, regional, and local offices.
“Without the emergency relief ordered by this Court, there would be the likelihood of irreparable harm to Petitioners.
Judge: Republicans Will Likely Win Pennsylvania Election Lawsuit

“Petitioners appear to have established a likelihood to succeed on the merits because petitioners have asserted the Constitution does not provide a mechanism for the legislature to allow for expansion of absentee voting without a constitutional amendment,” McCullough wrote.
When ruling on an emergency injunction, judges have to consider whether the party which requested the injunction is likely to win the case or “succeed on the merits.” McCullough opined that the “petitioners appear to have a viable claim that the mail-in ballot procedures set forth in Act 77 contravene” the plain language of the provision of the Pennsylvania Constitution which deals with absentee voting.
The Plantiffs pointed out that the State did not have to act so fast to certify the results and appear to have rushed it to try to avoid an injunction.
The Judge points out that the certification process is not finalized.
The emergency request underlined that while Pennsylvania completed vote-counting and submitted the signed certification to the U.S. archivist, a number of steps still remain for the formal certification process to be completed.
“While Respondents may have proactively attempted to avoid potential injunctive relief granted by this Court, Respondents duties with regard to finalization of the full election results are far from complete,” the filing states.
It’s not clear how many votes this applies to (though readers here may know that answer). This is not a Judgement, just a memorandum explaining the reasons for the court order. The evidence still needs to be presented in full. The Judge carefully explains at the end that harm would be done in tossing out 7 million votes of the people of Pennsylvania, but no harm is done in holding off until Dec 8th (the safe harbour date) to consider the evidence.
There are many hurdles to go, but this will help make it possible for other Judges to feel more confident in making similar decisions. There is a momentum effect with a gregarious species, and should that momentum hint that Trump has a reasonable chance, that could change so much. Suddenly a lot more players will want to be seen helping a “likely” winner.
Biden has been enjoying all that momentum so far thanks to the media’s rush to anoint him. The media cartel waited 34 days in 2000 for Al Gore to pursue the legal process, but declared it all over after 10 days despite (or rather because of) the massive legal battle coming.
The Wisconsin recount may be released this weekend
Officially Biden only leads by 20,000 votes in Wisconsin (WI) but apparently up to 100,000 votes may be tossed out due to one issue alone, and then there is that strange pattern in the counting….
In the video below, Steve Turley admits he’s an optimist, and unfortunately uses uses a few hyperbolic words like “implode” and the deadly triple !!!. Despite that, he speaks well and quotes a lot of data. He argues Wisconsin could be the “first domino to fall”, saying that WI does not allow mail in ballots that were not requested. Up to 60,000 mail in ballots in Milwaulkee County and 40,000 in Dane County were never requested and therefore should be tossed out. The State needs to supply the request for application for these mail in ballots. These two counties have 800,000 voters, a quarter of the state’s 3.3 million voters. The Trump Campaign has been forced to spend $3 million to even do a partial recount. The recount needs to be verified before the state can certify votes on December 1.
Democrats respond to these “baseless” allegations with emergency meetings to change recount rules. Nothing to see here then?
Following that news, Trump re-tweeted a post from Wisconsin Republican Party Chairman Andrew Hitt, who claimed that nervous Democrats at the state’s Elections Commission were subsequently trying to alter the recount rules.
‘WI Elections Commission, after seeing President Trump’s recount petition and objections, is trying to change the recount manual at an emergency meeting tonight at 6 pm to make objections harder to make. This must be stopped,’ Hitt wrote.

Witness addresses
To be valid, absentee ballots in Wisconsin must come in an envelope that is signed by the voter and a witness and include the witness’ address. In cases where witnesses don’t provide their addresses, clerks have been allowed to fill the addresses in if they know that information from talking to the voter, talking to the witness or looking at voter rolls, tax databases or other information.
That policy was set four years ago under guidance pushed by Republicans on the Elections Commission at the time, including Stephen King, who Trump later named as the U.S. ambassador to the Czech Republic. Trump didn’t dispute the state’s witness policy when he narrowly won Wisconsin in 2016, but he now says it is illegal. He argues only the voter or witness can write in the address.
Clerks say witnesses often forget to fill out their address or fail to supply a part of it, such as the city or ZIP code. In many cases, the witness is the spouse of the voter and lives at the same address.
Indefinitely confined voters
Most voters must provide a photo ID to get an absentee ballot, but those who identify themselves as indefinitely confined do not. This spring, Dane County Clerk Scott McDonell and Milwaukee County Clerk George Christenson suggested voters could label themselves as indefinitely confined if they were staying at home because of the coronavirus pandemic.
The state Republican Party sued and the state Supreme Court found the advice was faulty. The clerks rescinded their advice and pointed voters to guidance from the Elections Commission that noted it’s up to voters to determine for themselves whether they are indefinitely confined.
About 215,000 voters statewide called themselves indefinitely confined from the Nov. 3 election — up from 72,000 in a lower-turnout election for state Supreme Court last year.
Trump argues the ballots should be thrown out for voters who said they were indefinitely confined if they don’t meet the criteria.
Meanwhile In Pennsylvania
In Pennsylvania Turley argues that the heart and soul Republicans are now galvanized by the witnesses Trump presented and are taking this to the RINO’s in the party.
Among the many different allegations of fraud and impropiety in PA are the highly suspicious mail in votes that appear to not even be validated in some counties. Normally 1 – 3% of mail in votes would be rejected due to something about the vote being incorrectly filled in. First timers are more likely to make mistakes, but somehow this year with the record number of mail in votes in Pennsylvania the official rejection rate was just 0.3%. In Montgomery County Pennsylvania there is no record of even one mail in vote being rejected.
As Turley says: This is about the survival of the G.O.P. Can Trump defeat the Republican Swamp and rescue the party from itself?

Sidney Powell has dropped the bombshell cases in Georgia and Michigan
These cases are specifically suing the State officials. In Georgia, they are going after the Governor, Brian Kemp, and the Secretary of State, Brad Raffensberger. In Michigan, it is also the Governor, Gretchen Whitmer and Secretary of State, Jocelyn Benson.
“The scheme and artifice to defraud was for the purpose of illegally and fraudulently manipulating the vote count to make certain the election of Joe Biden as President of the United States.”
At least 96,600 absentee ballots were requested and counted but were never recorded as being returned to county election boards by the voter. “Thus, at a minimum, 96,600 votes must be disregarded,” the suit said.
Kemp and Raffensperger “rushed through the purchase of Dominion voting machines and software in 2019 for the 2020 Presidential Election” without due diligence and disregarded safety concerns.
“There is incontrovertible physical evidence that the standards of physical security of the voting machines and the software were breached, and machines were connected to the internet in violation of professional standards and state and federal laws.”
Fulton County election workers used a claim of a water leak to evacuate poll watchers and workers for several hours on Election night, even as “several election workers remained unsupervised and unchallenged working at the computers for the voting tabulation machines until after 1:00 AM.
State officials in a settlement with Democratic parties made changes to election procedures that violated both state law and the U.S. Constitution.
The pushback begins: Trump wins a stay on certification, and the right to put all the evidence forward at a hearing on Friday. Though as of this moment Google News Search results contain nothing but one report of a “far fetched strategy” to reverse Pennsylvania. A Pennsylvania state court issued an order blocking the certification of election results in the state, pending a hearing to be held on Friday, reports Fox News.
This is Judge Patricia McCullough’s court order. It’s not entirely clear what this means since Pennsylvania has been described as certifying the votes” already. Games of bluff are coming from both sides. Not surprisingly, officials in Pennsylvania are going to appeal this ruling.
Separately though, regardless of what is or is not certified, the elected representatives in Pennsylvania can choose to send their own electors in the event of major fraud.
Rudy Giuliani, who is leading the Trump campaign’s election legal efforts, on Wednesday suggested that Pennsylvania GOP state senators have the power to vote and choose their own electors, citing voter fraud allegations.

President Donald Trump, calling in at a Senate Republican hearing in Pennsylvania on Wednesday, called on GOP surrogates and his supporters to not back down in the face of threats and push back as his legal team challenges the result of the election.
“If you were a Republican poll worker you were treated like a dog,” Trump said on a call as his lawyer, Jenna Ellis, held up her phone to the microphone. He was referring to complaints from sworn affidavits about poll watchers being denied access to vote-tabulation efforts on Nov. 3 and beyond in places like Philadelphia and Detroit.
“Our poll watchers were pushed out of the building … don’t be intimidated by these people,” Trump said, while also referring to threats and a pressure campaign against his legal team.
“Due to the distance of the workers from the erected fences, it was impossible for me or any observer to see what the workers were doing with any type of specificity,” he said. “The observers were not able to challenge any decision or determination being made about the processing of these mail-in ballots.”
The second issue Qweder said he found to be irregular was the board’s duplication process. As the days progressed, observers were informed that the board was going to be duplicating damaged mail-in ballots that could not be read by their scanners. He was told there were more than 5,000 of these damaged ballots and that the actual number was unknown and could be higher.”

Twitter banned Senator Doug Mastriano’s Twitter account, possibly because he is asking why elections in Afghanistan are more secure than elections in Pennsylvania, an unpermitted question.
Imagine being an elected official with a PhD and 4 masters degrees who served in Desert Storm and was deployed 3x to Afghanistan .. but can’t speak freely on twitter. That’s what it’s come to.
He also said in the hearing that thousands of people have been contacting his office. They have been inundated.
